how the republican deal unravelled tonight. lillian. >> it was a long night. house republican leader bought 19 box of pizza to get through it. but none matter. most conservative member of the republican caucus weren't budging. speaker of the house boehner expressed confidence he would get his debt ceiling bill passed. >> when the house takes action today united states senate will have no more excuses for inaction. >>reporter: as the day went on however it became clear speaker boehner didn't have the votes. g.o.p. leaders halted debate on the floor then spent hours convincing members of the tea party to go along but to no avail. >> republicans took advantage of the tea party express and tea party caucus when they seize control of the house and so frankly now the governing challenge is how do you translate anger against president into a governing coalition. thus far haven't been able to do that. >>reporter: boehner plan would have cut 900 billion dollars in

>> so what happens if congress can not agree on raising the debt ceiling? tax revenue will continue to flow into the treasury but not nearly enough. 178 billion dollars in august to cover 308 billion worth of bills. tough choices will have to be made. get paid and who doesn't. we learned top priority will be paying the interest on the existing debt. >> as of tonight apple has more cash than the federal government. at least on pavement u.s. treasury department says it now has 73 billion dollars in cash under the current debt ceiling. last week the cupertino company reported its cash reserve was nearly 76 billion. >> san francisco police say they have found the gun now that killed a man they were chasing in the bay view. police say this is the weapon that mean-year-old kenneth harding was carrying when he confronted officers on july 16. it's a 380 caliber semi-automatic pistol. sf pd uses a 40 caliber side arm. police believe that harding accidentally shot himself in the head after he suffered a

gunshot wounds to the leg during the shoot out with officers. police say they recovered the gun from unidentified bay view resident who may have taken it from the crime scene. but some community activist want access to that gun to make sure there is no coverup. >> we would have to see the an independent review panel just to see if that was the right gun. >> these are objective factual scientific tests and they are all lining up corroborating the stories of the officers and the independent witnesses to the event. >>reporter: there are 4 independent investigations already under way into the shooting. >> good samaritan shot early wednesday morning while feeding the homeless in east oakland has died of his wounds. tonight detectives are trying to find a motive for the murde murder. 29-year-old paris powell known as brother john was shot in the head when someone in the car opened fire on him and his family. his pregnant wife and young daughter were also wounded. there is now a small memorial on 47 avenue where the shooting took place. >> several bay area men being

called hero after coming to the aid of a pilot attacked on plane heading to san francisco. florida prosecutors filed felony battery and assault charges today against brothers luis and jonathan diaz of puerto rico. they punched the pilot after ordered off the american air lanes flight in miami. passengers say the brothers appeared to be drunk or maybe on drugs. >> we were all really scared. we knew that these guys were really weird in the beginning and shouldn't have been let on the plane >> there was a scuffle that took place if so about 3 or 4 of us went out there and tackled the guy. we just did what we needed to do to help out. >>reporter: the plane was still on the runway and had not yet taken off. good samaritan held the two men down for 10 minutes in the terminal until authorities took them into custody. >> man faking an emergency has been arrested on kidnapping charges. police say that isaac forced his way in a woman car in novato. 62-year-old victim says the suspect yelled something about a pregnant woman going into labor tonight

when this happened. the victim drove down 101 and exited at alameda del practiced 0where she stopped the car and started screaming. the suspect ran away. he was arrested short time later. police believe the same man may have tried to flag down other drivers before he was captured. the fate of california voter enacted ban on gay marriage could be decided this fall. california supreme court has scheduled a september 6 hearing on proposition 8. at issue whether sponsors of the measures have the authority to fight rulings against it. if the governor and attorney general refuse to pea. the question is pivotal to the 2008 ban. both former governor schwarzenegger and former attorney general jerry brown refused to challenge the ruling that struck down the law. >> in the deep end and in deep trouble a south bay father and his daughter nearly drowned in a community swimming pool. firefighters say had it not been for the heroic action of 2 men the pair would not have survived. lisa reports from san jose. >> took it 1 or 2 steps right

on up and went over and girl was right down here. >>reporter: jeff bail didn't think twice about the 7 foot high sharp fence that stood between him and a little girl who lay unconscious on the other side. she and her parents were guest of a resident at regency park town homes. one minute the 6-year-old was on her father's shoulders in the pool and the next there was silence. >> he climbed into the pool and he didn't see them. it was dark. so he noticed a shadow at the deep end of the pool. he immediately swam over to it looked under the water and saw them at the pwol of the pool together. very traumatic. >>reporter: he is unnamed hero no. 1. he's also the resident the family was visiting. he single handedly dove and brought both the girl and her 44-year-old father back up to the surface and that's when jeff bail hero no. 2 stepped in. >> mother of the girl if said she didn't know how to do cpr so i took over. >>reporter: high school social

>> closed captioning brought to >> closed captioning brought to you by mancini sleepworld. >> police have found at least one marijuana cultivation site near the area where a park police officer was attacked earlier this week in the east bay. regional park officer was on routine patrol south of mile an hour ago a when gunmen opened fire on him. officer fired back and called for help. he was rescued by an armored vehicle. extensive search of the area took place. aerial surveillance has now uncovered at least one active grow site there although it is still not clear if it is related to the shooting. >> the search for clue into the san bruno pipeline explosion is being done underground this week. pg&e digs up a section of pipe abandoned since the mid 19 fwichlts as reported at one time it was part of the line that exploded last september. >>reporter: pg&e digging up a section of pipe that has been in the ground since 1948.

unused since 1956. that's when line 1 32 was rerouted a bit to accommodate the new housing development. c p uc wants to take a look at pipe from the original line 1 32 as part of its investigation into the explosion along segment of the replacement pipe. 8 foot section will be cut out on glen view north of carry mont handed over to the c p uc. another excavation point 250 feet south west. just feet from the rupture site at glen view and earl. this is so a camera can inspect the inside of the entire length of abandoned pipe. >> basically put the camera in one end and 7 it at the other end. >> ntsb says the september rupture started on one of multiple poorly done weld so pg&e records had shown a seamless 30 inch sealed pipe. the report will be issued on the probable cause in about a month from ntsb. explosion and resulting fire killed 8 people and destroyed 38 homes. bob

a waiting get away car. investigators believe the crimes are motivated by the rising praise of gold. >> 150 people are now out of work after jackson ranch casino cut 10% of the work force. officials at the am door county ka sean 0say the cut back come at the same time as 100 million dollar renovation. even though the casino is adding new restaurants, slot machines and other amenity they are still down sizing. casino laid off 115 employees back in 2009. growing number of hotels are using radio frequency chips to keep those plush robes and towels disappearing. company that says trackable linen hotel lose 25% of the linen every month. hotel guest are taking bath robe, bed sheet, bath mat, pal towel that sort of think. chips are season into the fabric and read by sensors up to 6 feet away. one hotel in hawaii started using the chip and began saving 16,000 dollars a month. fichlt so far unseen
